SC ‘Clean, thoroughbred, white girl’ touts career, clean record to avoid DUI

Lauren Elizabeth Cutshaw DUI arrest dash camera vdeo. BLUFFTON, S.C. – In-car audio and dash camera video released Wednesday by police do not contain a South Carolina woman’s now-infamous alleged excuse for why she shouldn’t be arrested and charged with DUI. But the Bluffton Police Department’s video of Lauren Elizabeth Cutshaw’s DUI arrest does show her making desperate pleas to the arresting officer not to take her to jail, for a variety of reasons. Cutshaw, 32, told the officer the night of her Aug. 4 arrest she’d been out celebrating her upcoming birthday before Bluffton police reportedly saw her run a stop sign at 60 mph, prompting the traffic stop. Cutshaw told the officer she had had two glasses of wine that night. 

When the officer placed Cutshaw in the back of his patrol vehicle, she seemed in disbelief. During the ride to the police station, Cutshaw, sobbing throughout, repeatedly stresses she has a clean criminal history. The officer tells Cutshaw he would’ve arrested her for reckless driving even if he hadn’t suspected her of DUI. Along with her self-professed spotless criminal record, Cutshaw also points out her apparently stellar academic record and her involvement in extracurricular activities as a student. Cutshaw also later told her arresting officer she had been a sorority girl and a dancer, an incident report shows. 

Appeals to her prior track record not gaining traction, Cutshaw is recorded instead pleading to the officer to consider her career and how driving is an integral part of it. Cutshaw even resorts to name-dropping a business partner she claims also is a law enforcement officer. As the police cruiser gets closer to the detention center, Cutshaw becomes inconsolable. It was inside the detention center, after the in-car camera was off, where police say Cutshaw began using her race and gender as excuses to avoid jail.

Teen charged with DUI, child endangerment in deadly SC crash

A 19-year-old South Carolina woman faces DUI and child endangerment charges in a Saturday crash that killed a 17-year-old and injured three others, including two 13-year-old children, according to troopers. The deadly crash happened just before midnight on U.S. 25 near Pine Hill Drive, according to Cpl. Bill Rhyne of the S.C. Highway Patrol. That’s in the Travelers Rest area of Greenville County, about 15 miles north of Greenville. 

A 1997 Jeep Cherokee was traveling south on U.S. 25 when the driver, 19-year-old Madison Bagwell of Pickens, lost control of the SUV, Rhyne said. The Jeep went off the left side of the roadway and into the grass median, where it overturned and came to rest in the northbound lanes. Bagwell’s front seat passenger, a 17-year-old woman, was airlifted to Greenville Memorial Hospital, where she later died, Rhyne said. Two of them – a boy and a girl, both 13 and from Pickens – were taken by ambulance to Greenville Memorial Hospital with injuries. A 20-year-old passenger in the back seat also was taken to Greenville Memorial with injuries, Rhyne said. 

The three back seat passengers and Bagwell were all wearing seat belts, Rhyne said. Bagwell is charged with one count of felony DUI resulting in death, two counts of felony DUI resulting in great bodily injury, one count of child endangerment and one count of simple possession of marijuana, Rhyne said. Under South Carolina law, felony DUI resulting in death carries a sentence between one and 25 years in prison and a $25,100 fine; felony DUI resulting in great bodily injury carries a sentence between 30 days and 15 years and a $10,100 fine.

LAWMAKER DUI INVESTIGATION PART I

Coroner identifies 11-year-old girl killed in fatal downtown crash

Selma Akguel, 11, of Middelfart, Denmark has been identified as the pedestrian struck by the SUV, according to Deputy Coroner Sheila Williams. A 2014 Nissan Pathfinder sport utility vehicle driven by Jeffrey William Wakefield, 30, of Dogwood Road, was traveling south on Rutledge Avenue, Francis stated. The vehicle went through the intersection, onto the sidewalk on the south side of the intersection and struck an Selma, according to the report. The report states that the girl was transported to MUSC with life threatening injuries. Selma was taken off of life-support earlier this morning, the report added. 

Wakefield showed signs of impairment and failed a standardized field sobriety test at the scene, according to the report. After providing a breath sample, he was transported to St. Francis Hospital where he submitted blood and urine samples which will be sent to the South Carolina Law Enforcement Division for testing, the report stated. Wakefield is charged with felony driving under the influence and reckless homicide, Francis added. Investigators have determined that Wakefield was involved in a hit and run accident at Rutledge Avenue and Morris Street prior to the incident at Calhoun Street and Rutledge Avenue. 

The report also states that he struck an unoccupied parked vehicle. At his bond hearing this afternoon, Wakefield received a $50,000 bond for the charge of reckless homicide and he was denied bond for the charge of felony driving under the influence. No bond set for Wakefield’s DUI charge, must be set by circuit court judge.

Police: Driver in crash that killed 11-year-old girl had 0 percent alcohol content

The datamaster showed Jeffrey Wakefield, 30, had no alcohol in his system, according to the reports. The test was given to Wakefield after the crash, but wouldn’t have shown any additional drugs that could have been in his system at the time. The results of blood and urine samples taken from Wakefield will take a longer amount of time to come back. Selma Akguel, of Middelfart, Denmark, was later identified as the victim struck by Wakefield’s SUV which sped through the intersection of Calhoun Drive at Rutledge Avenue before going up onto the sidewalk and killing her, Charleston Police Chief Luther Reynolds said. A judge gave Wakefield a bond of $50,000 for the reckless homicide charge but denied bond on the felony DUI charge,. 

Wakefield claimed he had been out drinking with a friend and only had non-alcoholic beer prior to the crash.

It is a crime in South Carolina to drive with a blood alcohol concentration of.08 or more. This law targets and punishes the status of simply having a BAC at or above. While the State is not specifically required to prove impairment beyond a reasonable doubt in DUAC cases, they must prove that there was probable cause that the driver was materially and appreciably impaired in order to justify the arrest. Given the inability of the investigating officer to determine a driver’s BAC at the roadside, the arrest must always be for the impairment based offense of DUI. While the blood alcohol concentration is the heart of the State’s case in a DUAC prosecution every aspect of the investigation is significant and must be tested. 

The law permits a jury to consider every part of the case when deciding whether to accept the result of the breath or blood test as proof beyond all reasonable doubt of the true blood alcohol concentration. The prosecution has the very real burden of proving the accuracy and reliability of their evidence, not simply presenting a number from a machine. The arresting officer has the option of changing the charge from DUI to DUAC after the driver’s blood alcohol concentration has been determined from the analysis of a breath or blood sample. The law does not allow the prosecution of both charges out of the same arrest, an officer must chose to prosecute one charge or the other no later than 30 days before the trial date.

WTAT-TV/DT » Walterboro Officer Resigns Following DUI Arrest

WALTERBORO, SC – A Walterboro city police officer has resigned following his DUI arrest over the weekend. Troopers say 42-year-old Bert Sweat was traveling east on I-26 when he ran off the road near mile marker 172. Sweat was taken into custody and transported to an area hospital for treatment. He was later charged with driving under the influence. Highway Patrol says the vehicle Sweat was driving belonged to the City of Walterboro. 

He was reportedly off-duty at the time of the crash.

Man charged with felony DUI in deadly Ravenel crash

CHARLESTON COUNTY, SC – A man is facing charges following a deadly crash on Savannah Highway in Ravenel Thursday night. Clifford Maxwell, 60, has been charged with felony DUI in connection with the crash that killed one person and left another seriously injured. The accident happened in the area of the 4600 block of Savannah Highway and involved two vehicles.
